Welcome to QWK, your trusted delivery service platform for food, groceries, pharmaceuticals, and more. These Terms and Conditions ("Terms") govern your use of our services provided through our mobile application, website (www.qwk.app), and any related services provided by QWK ("we", "us", or "our"). By using our platform, you agree to be bound by these Terms, our Privacy Policy, and any other rules and guidelines applicable to the use of QWK.

Please read these Terms carefully before accessing or using our services. If you disagree with any part of the Terms, you must not use our services.


1. Definitions

For purposes of these Terms, the following definitions apply:

  • QWK Platform: Refers to our website, mobile app, and any other related online service operated by QWK.
  • User: Refers to the person or entity accessing or using the QWK Platform. This includes customers placing orders, stores, restaurants, pharmacies, and delivery agents registered on the QWK platform.
  • Partner: Refers to businesses, such as restaurants, grocery stores, and pharmacies, partnering with QWK to offer goods and services to users.
  • Delivery Agent: Refers to individuals contracted or registered with QWK to deliver goods ordered through the platform.
  • Content: Refers to any text, images, photos, audio, video, or other multimedia content provided by QWK, partners, or users.
  • Order: Refers to the request for goods or services made by the user via the QWK Platform.

2. Eligibility

You must be at least 18 years old to use the QWK Platform. By agreeing to these Terms, you represent and warrant that:

  1. You are legally capable of entering into binding contracts.
  2. All information you provide to us is accurate, current, and complete.
  3. You will maintain the security of your account credentials.

3. User Accounts

  • Account Creation: To use certain features of QWK, such as placing an order, users must create an account. The user is responsible for maintaining the confidentiality of their account information.

  • Account Security: You agree to notify QWK immediately of any unauthorized use of your account or any other breach of security. QWK will not be liable for any loss or damage arising from your failure to comply with this security obligation.

  • Account Termination: QWK reserves the right to suspend or terminate your account for violating these Terms or any other QWK policy.


4. Services Offered

QWK connects users with partners (such as restaurants, grocery stores, and pharmacies) and delivery agents to facilitate the purchase and delivery of goods. Services provided by QWK include, but are not limited to:

  • Ordering: Users can place orders from registered partners on the QWK Platform.
  • Delivery: Orders are delivered by delivery agents contracted with QWK.
  • Order Tracking: QWK offers real-time order tracking for all placed orders.
  • Customer Support: QWK provides customer care and support through various channels, including in-app chat, email, and phone.

5. Order Process and Fulfillment

  • Order Placement: Users may place orders through the QWK Platform by selecting products from partner businesses. Once an order is placed, the user will receive a confirmation via the app and/or email.

  • Order Acceptance: Orders are subject to acceptance by the partner. QWK is not responsible for any refusal or cancellation of an order by a partner.

  • Order Preparation and Delivery:

    • For food and grocery items, the estimated preparation and delivery time will be displayed at the time of order placement.
    • Users can track their orders in real-time.
    • If there is a delay in the preparation of the order by the partner, the delivery will be rescheduled accordingly.
    • The user is responsible for providing accurate delivery instructions and ensuring someone is available to receive the order.
  • Cancellation: Users may cancel an order within a specific time frame after placing it, depending on the partner’s cancellation policy. Once the preparation has started, cancellations may not be possible, and the user may be charged the full amount.

  • Refunds and Returns: Refunds are subject to QWK’s and the respective partner’s return and refund policy. If the delivered product is incorrect, damaged, or expired, you may be eligible for a refund or exchange. Users must notify QWK within 24 hours of delivery.


6. Pricing, Payment, and Fees

  • Pricing: All prices for goods and services are determined by the respective partner and are displayed on the QWK Platform. Prices may vary based on location, availability, promotions, and partner discretion.

  • Service Fees: QWK may charge users service fees, including delivery fees, platform service fees, and other applicable charges. These fees will be clearly displayed at checkout.

  • Payment: Payments for orders are made through the QWK Platform via various payment methods, including credit/debit cards, mobile wallets, and other approved digital payment methods. All payments must be made in full at the time of placing the order.

  • Taxes: All applicable taxes will be included in the total amount displayed at checkout. Users are responsible for any local taxes or fees associated with their order.


7. Partner Responsibilities

  • Partner Listings: Partners are responsible for providing accurate information about their offerings, including descriptions, prices, and availability.

  • Order Fulfillment: Partners are responsible for preparing and packaging the order correctly and promptly. Any delays or errors in fulfillment are the responsibility of the partner.

  • Complaints: In the event of any complaints or disputes related to an order, the partner must cooperate with QWK to resolve the issue.


8. Delivery Agent Responsibilities

  • Delivery Times: Delivery agents are required to deliver orders within the estimated delivery time displayed to the user. Any significant delays must be communicated to QWK and the customer.

  • Professional Conduct: Delivery agents must conduct themselves professionally and courteously when interacting with users and partners. They must adhere to QWK’s code of conduct.

  • Order Handover: Delivery agents are responsible for ensuring that the correct order is delivered to the user. Any issues with the order must be reported to QWK immediately.


9. User Conduct

By using QWK, you agree to:

  1. Provide accurate information at all times, including contact and delivery details.
  2. Comply with all applicable laws and regulations while using the QWK Platform.
  3. Not engage in any activity that would disrupt the functioning of the QWK Platform, including hacking, unauthorized access, or data breaches.
  4. Not use the Platform for illegal or unauthorized purposes.
  5. Treat QWK staff, partners, and delivery agents with respect and courtesy.

10. Intellectual Property

  • Ownership: All content, design, software, and materials on the QWK Platform are owned by or licensed to QWK. Unauthorized use of any of QWK’s intellectual property is prohibited.

  • Trademarks: QWK’s trademarks, logos, and branding may not be used in any way without prior written consent from QWK.


11. Privacy and Data Protection

Your use of the QWK Platform is also governed by our Privacy Policy, which outlines how we collect, store, and use your personal information. By using the Platform, you consent to the collection and use of this information as described.


12. Limitation of Liability

To the fullest extent permitted by law, QWK is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the QWK Platform, including but not limited to:

  • Errors or inaccuracies of content or products listed by partners.
  • Delays, errors, or issues in delivery.
  • Unauthorized access to your account or personal data.
  • Any disputes between users and partners.

13. Indemnification

You agree to indemnify and hold QWK, its affiliates, partners, delivery agents, and employees harmless from any claim or demand, including legal fees, made by any third party arising out of:

  1. Your use of the QWK Platform.
  2. Your violation of these Terms.
  3. Your violation of any third-party rights, including but not limited to intellectual property rights.

14. Dispute Resolution

Any disputes arising out of or in connection with these Terms or your use of the QWK Platform shall be resolved through amicable negotiation. If a resolution is not achieved, the dispute shall be settled by binding arbitration in Egypt, in accordance with the Egyptian Arbitration Law. Either party may seek injunctive or other equitable relief in court for matters related to intellectual property or data security.


15. Termination

  • Termination by QWK: We may terminate or suspend your account immediately, without notice, if you breach these Terms.

  • Termination by You: You may deactivate your account at any time. However, any obligations incurred prior to termination (including outstanding orders) will remain binding.


16. Amendments and Updates

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the QWK Platform. It is your responsibility to review these Terms regularly. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.


17. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in effect.

  • Waiver: The failure of QWK to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

  • Entire Agreement: These Terms, together with any additional agreements, represent the entire agreement between you and QWK regarding the use of the Platform and supersede all prior agreements or understandings.
